This website is maintained by Applied Governance Group LLC (“Applied Governance,” “we,” “us,” or “our”). These Terms of Use govern access to and use of this website and the content, features, and resources made available through it (collectively, the “Site”). By accessing or using the Site, you agree to these Terms of Use.
1. Acceptance and Changes
By using the Site, you agree to comply with these Terms of Use. Applied Governance may modify the Site or these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.
2. Informational Purposes; No Attorney-Client Relationship
Content on the Site is provided for general informational purposes and does not constitute legal advice regarding any particular facts or circumstances. Accessing the Site, sending an email, or otherwise contacting Applied Governance through information provided on the Site does not by itself create an attorney-client relationship. An attorney-client relationship is formed only through an applicable written engagement agreement. You should not send confidential or sensitive information unless and until an attorney-client relationship has been established and you have been instructed that such information may be provided.
3. Ownership and Intellectual Property
Unless otherwise indicated, the Site and its content—including text, graphics, logos, designs, frameworks, written materials, and other content—are owned by Applied Governance or used with permission and are protected by applicable intellectual-property laws. No license or ownership interest is granted to you except the limited right to access and use the Site for lawful, personal, and internal business informational purposes.
You may not reproduce, distribute, modify, republish, transmit, commercially exploit, or create derivative works from Site content without prior written permission from Applied Governance, except as permitted by applicable law. You may not remove proprietary notices; interfere with the Site's operation or security; introduce harmful code; use the Site unlawfully or to violate another person's rights; or use automated means to scrape, extract, harvest, or systematically access Site content, including for training, developing, modifying, or enhancing artificial-intelligence or machine-learning models, except that operators of public search engines may use automated tools solely as reasonably necessary to create publicly available search indexes, subject to any technical restrictions we implement.
4. Third-Party Links
The Site may contain links to third-party websites or resources. Applied Governance does not control and is not responsible for third-party content, availability, security, or privacy practices. A link does not constitute endorsement of the third party or its content.
5. Governing Law
These Terms of Use and any dispute arising out of or relating to the Site or these Terms will be governed by the substantive laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws principles, except to the extent federal law, including the Federal Arbitration Act, applies.
6. Mandatory Arbitration; Individual Proceedings; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to the Site, your use of the Site, these Terms of Use, or the relationship between you and Applied Governance (a “Dispute”) will be resolved exclusively through final and binding arbitration on an individual basis rather than in court. The arbitration agreement in this Section is governed by the Federal Arbitration Act.
Before initiating arbitration, the party asserting a Dispute must provide the other party written notice describing the nature and basis of the claim and the relief sought and allow at least 30 days for the parties to attempt in good faith to resolve the Dispute informally. Notices to Applied Governance may be sent to appliedgovernancegroup@gmail.com.
If the Dispute is not resolved informally, it will be administered by the American Arbitration Association (“AAA”) under the AAA rules applicable to the nature of the Dispute, as modified by these Terms. Unless the parties agree otherwise, the arbitration will take place in Pennsylvania or remotely where permitted by the applicable rules. The arbitrator will have authority to award any remedy that would otherwise be available to an individual party under applicable law, subject to these Terms.
ALL DISPUTES MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY. YOU AND APPLIED GOVERNANCE EACH WAIVE, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY RIGHT TO HAVE A DISPUTE HEARD OR RESOLVED AS A CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION OR ARBITRATION, INCLUDING ANY PROPOSED CLASS ACTION. THE ARBITRATOR MAY AWARD RELIEF ONLY TO THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO RESOLVE THAT PARTY'S INDIVIDUAL CLAIM.
If applicable law prohibits arbitration of a particular claim or request for relief, that claim or request will proceed in a court of competent jurisdiction only after all arbitrable matters have been resolved, unless applicable law requires otherwise. Nothing in this Section prevents either party from seeking temporary or preliminary injunctive relief from a court where necessary to preserve the status quo or prevent imminent irreparable harm pending arbitration.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, APPLIED GOVERNANCE AND ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, VENDORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, LOSS OF PROFITS OR REVENUE, BUSINESS INTERRUPTION, OR OTHER LOSSES ARISING OUT OF OR RELATING TO THE SITE OR YOUR USE OF OR INABILITY TO USE THE SITE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF APPLIED GOVERNANCE AND THE FOREGOING PARTIES FOR CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED TEN DOLLARS ($10.00). Some jurisdictions do not permit certain exclusions or limitations, in which case the applicable limitation will apply only to the fullest extent permitted by law.
8. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Applied Governance and its members, officers, employees, agents, contractors, and service providers from third-party claims, liabilities, damages, losses, and reasonable attorneys' fees arising from your unlawful use of the Site, your material violation of these Terms, or your violation of another person's rights. Applied Governance may assume control of the defense of a covered claim, and you agree to provide reasonable cooperation.
9. Suspension or Termination
Applied Governance may suspend, restrict, or terminate access to the Site where reasonably necessary to protect the Site, Applied Governance, its users, or third parties; to address suspected misuse; or as otherwise permitted by law.
10. Severability
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted or severed as appropriate, and the remaining provisions will remain in full force and effect. With respect to the class-action waiver and arbitration provisions, severability will be determined consistently with applicable law and the Federal Arbitration Act.

This Site may constitute attorney advertising. Prior results and experience do not guarantee a similar outcome. Descriptions of representative experience and results are provided for informational purposes and are not a promise or guarantee of any particular result.
